ICON Loyalty Club Terms and Conditions

By participating or continuing to participate in ICON Loyalty Club, you agree to the following:

ICON Loyalty Club is the loyalty program (“ICON Loyalty Club”, the “Program” or the “Club”) as it may be provided from time to time to Program members (“members”, “you” or “your”) by Lion Global Property Management Ltd, its affiliates, subsidiaries, and related companies (“ICON”, “ICON STAYS”, “we”, “us”, or “our”). ICON Loyalty Club offers its members several benefits and services.

These terms and conditions (the “Program Terms”) govern your membership and participation in ICON Loyalty Club, and it is your responsibility to read and understand all of them. ICON may at any time in its sole discretion and without notice or liability, terminate, amend, modify, or supplement ICON Loyalty Club, Club benefits, or the Program Terms. By becoming and remaining a member of the ICON Loyalty Club, and receiving and utilizing benefits and services, you agree that you have read, understand, and accept these Program Terms as amended from time to time. Membership and Club benefits are offered at the sole discretion of ICON.

  1. ICON Loyalty Club Definitions
    1. “Partners” means third parties and their service providers that provide benefits to ICON Loyalty Club Members from time to time. Partners and the Program benefits provided by each Partner are subject to change at any time without notice. Nothing in the Program Terms is intended to or shall create or establish any agency, partnership, or joint venture relationship between us and our Partners.
  2. Membership in ICON Loyalty Club
    1. Eligibility: Application for membership in ICON Loyalty Club is open to individual persons who are of majority age in their place of residence. ICON Loyalty Club members must provide and maintain an accurate email address and an accurate physical address, including city and country of residence. An individual may maintain only one ICON Loyalty Club membership. Membership and participation in ICON Loyalty Club is void where prohibited by applicable law, rule, or regulation.
    2. Enrolment: You may apply for membership in ICON Loyalty Club, online here, or by telephone at the number listed below. We may, in our sole discretion and without any liability to you, accept or decline your application for membership in ICON Loyalty Club. If we accept your application for membership, we will send you a membership confirmation email.
    3. Membership Obligations: As an ICON Loyalty Club member, you agree to comply with these Program Terms, the applicable terms and conditions of our Partners, and all applicable laws, rules, and regulations. You agree that your participation in ICON Loyalty Club is entirely at your own risk. You agree that if you object to any of these Program Terms, or any modifications thereof, or otherwise become dissatisfied with ICON Loyalty Club, your only recourse is to terminate your membership. You agree that you are responsible for restricting access to and maintaining the confidentiality of your ICON Loyalty Club membership Number, and Discount codes provided to you from time to time. You also agree to promptly notify us if your membership details are lost, stolen, or compromised. You agree that you will provide accurate information to us at all times and promptly notify us of any change in your information. You understand that the receipt of benefits as an ICON Loyalty Club member may be subject to tax liability, and agree that any tax liability, including disclosure, with respect to your membership in ICON Loyalty Club is solely your responsibility.
    4. Termination of Membership:
      1. Termination of Your Membership in ICON Loyalty Club: You may terminate your membership in ICON Loyalty Club at any time by contacting us.
      2. Other Modifications to and Termination of Your Membership in ICON Loyalty Club by Us: In addition to the above, we may, at any time in our sole discretion and without notice or any liability to you, modify, suspend, or terminate your membership in ICON Loyalty Club. We may take these actions for the convenience of ICON Loyalty Club, or if there are reasonable grounds for suspecting, in our sole discretion, that (i) you have violated or are using the Program in a manner inconsistent with these Program Terms or the intent of the Program or any portion of the Program; (ii) you have misused or abused ICON Loyalty Club; (iii) your membership activity or status involves or results from fraud, dishonesty, theft or other illegal or improper means; (iv) you knowingly attempt to obtain or maintain more than one ICON Loyalty Club membership (v) your membership or participation in ICON Loyalty Club violates any applicable laws, terms or regulations; (vi) our provision of benefits under ICON Loyalty Club violates any applicable laws, terms or regulations; or (vii) you fail to pay any amounts due to or engage in abusive, in appropriate, offensive, or hostile conduct in connection with ICON Loyalty Club or our Partners, or their respective officers, directors, agents, employees, representatives or guests. These rights are in addition to any other remedy which may be available to us under applicable law, and we have the right to take appropriate administrative and/or legal action, including, without limitation, criminal or civil prosecution, we deem necessary in our sole discretion.
  3. ICON Loyalty Club Benefits
    1. Services Provided by our Partners: You acknowledge and agree that: (i) in some cases the actual use and enjoyment of Benefits by a member may be not provided by ICON STAYS but by our partners; (ii) ICON STAYS utilizes the Program to facilitate communications between the Members and our partners, so the Members can obtain the Benefits direct from them; (iii) any claims, damages, liabilities, and expenses of any kind or nature arising from, relating to or associated with the Member’s use or enjoyment of the Benefits provided by any party other than ICON, will be brought by the Member exclusively against that party only, and will be subject to the Member’s contract with that party (whether express or implied).
    2. Available Benefits: A list of the currently available Benefits can be found here. Such benefits may be changed, substituted, or deleted by ICON STAYS from time to time at ICON’s discretion and are subject to availability.
    3. Transfer of Benefits: Except as expressly set forth in these Terms and Conditions, Benefits made available to Members are void if a member sells, barters, auctions, donates, assigns, conveys, or otherwise transfers them (or makes any attempt to do so) in a manner not expressly allowed by these Terms and Conditions or otherwise permitted by ICON (in writing) in its sole discretion.
    4. Benefits are subject to all applicable laws, rules, and regulations.
    5. Identification of Members: Members will only be entitled to receive the benefits if they have clearly identified themselves to the ICON front desk staff at check-in and provided their ICON Loyalty Club Membership Number.
    6. Conjunction of Benefits: Unless otherwise stated, the Benefits cannot be used in conjunction with any other promotions or discounts.
  4. General
    1. Subject to Applicable Law: Membership and participation in ICON Loyalty Club, and the provision and utilization of benefits, are subject to and may be void where prohibited or restricted by applicable law, rule or regulation, or employer’s or customer’s policies or requirements.
    2. Disclaimer of Warranties and Limitation of Liabilities
      ICON OFFERS ICON LOYALTY CLUB, THESE PROGRAM TERMS, AND ANY OTHER RELATED SERVICES AND PRODUCTS “AS-IS” AND, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EXPRESSLY DISCLAIMS ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DESIGN, ACCURACY, CAPABILITY, SUFFICIENCY, SUITABILITY, CAPACITY, COMPLETENESS OR AVAILABILITY. WITHOUT LIMITING THE FOREGOING, ICON DOES NOT REPRESENT, WARRANT, OR GUARANTEE THE ICON LOYALTY CLUB OR ANY OTHER RELATED SERVICES AND PRODUCTS WILL BE UNINTERRUPTED, WITHOUT OMISSIONS OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED OR CHANGES IMPLEMENTED.

      YOU AGREE THAT UNDER NO CIRCUMSTANCES INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, WILL ICON, ITS OWNERS, AFFILIATED AND SUBSIDIARIES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS HAVE ANY LIABILITY OR RESPONSIBILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES TO PERSONS, INCLUDING WITHOUT LIMITATION PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE ARISING IN WHILE OR IN PART, DIRECTLY OR INDIRECTLY, FROM MEMBERSHIP OR PARTICIPATION IN ICON LOYALTY CLUB OR USE OF BENEFITS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

      Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages; therefore, such exclusions may not apply to you. In the event, any of the foregoing is held liable for any damages related to such matters, your sole, and exclusive remedy will be limited to reimbursement for services or products paid by you to the entity held liable which were not provided by such entity.
    3. Indemnification: You agree to indemnify, release, and hold harmless ICON, the participating properties, our Partners, and any of their parents, subsidiaries and affiliates, and their respective directors, officers, employees, and agents, from any liability, costs, damages, and fees (including attorneys fees) arising out of any claims related to your membership in ICON Loyalty Club.
    4. Program Modifications or Termination: We reserve the right at any time, in our sole discretion, with or without notice and without any further liability or obligation, even though changes may affect the value of benefits already accumulated, to (i) add, modify, delete, change, suspend or terminate (“Change”) ICON Loyalty Club, in whole or in part; including without limitation any of the rules, procedures, conditions, benefits, awards, award levels, Participating Properties, Partner affiliations and opportunities, earning terms, redemption rules, or award availability (ii) Change these Program Terms, in whole or in part; (iii) Change any ICON Loyalty Club offers; or (iv) assign in whole or in part ICON Loyalty Club to any related or unrelated entity. Upon assignment, the performance of the obligations herein will thereafter be the sole and direct responsibility of that entity. In the event of the termination of ICON Loyalty Club, any benefits not utilized by the termination date of ICON Loyalty Club will be forfeited without compensation or any further obligation or liability, and no utilization of benefits will be honored thereafter. All offers are available while supplies last, subject to any applicable cancellation policies, and are subject to change and/or revocation without notice.
    5. Governing Law and interpretation: Your enrolment application and benefits earning, and redemption claims under ICON Loyalty Club are subject to our verification and acceptance in our sole discretion, all which acts shall be deemed made, performed, transacted, and closed in Cyprus. Any claim or dispute arising or relating thereto or otherwise involving ICON Loyalty Club, membership, or these Program Terms shall be governed and construed in accordance with the laws of the Republic of Cyprus, without regard to its choice of law or conflict of laws terms. All interpretations of the Program Terms shall be at the sole discretion of ICON. The English language version of the Program Terms governs.
    6. . Statute of Limitations: All rights to bring any claim or action relating to the Program, the Program Terms, any award, any redemption, or the parties' relationship must be brought within two (2) years after the first occurrence of the kind of act, event, condition, or omission upon which the claim or action is based.
    7. . Attorneys' Fees: The prevailing party in any action or proceeding arising under, out of, in connection with, or in relation to the Program, the Program terms, any award or reimbursement, or the parties’ relationship is entitled to recover its reasonable attorneys' fees and costs.
    8. Force Majeure: Our failure to administer ICON Loyalty Club in accordance with these Program Terms because of an act of God, war, fire, riot, terrorism, earthquake, actions of federal, state, or local governmental authorities, including but not limited to the imposition of sanctions, or for any other reason beyond our reasonable control will not be deemed a breach of these Program Terms.
    9. Entire Agreement/Waiver: These Program Terms and the other terms expressly referenced herein and linked hereto constitute the entire agreement between you and us regarding your participation in ICON Loyalty Club and your entitlement to any benefits of ICON Loyalty Club. If we fail to act with respect to your breach or anyone else's breach of these Program Terms on any occasion, we do not waive our right to act with respect to future or similar breaches.
    10. Severability: If any provision of these Program Terms is held by a court of competent jurisdiction to be void, invalid, contrary to law, or unenforceable for any reason, such provision shall be changed and interpreted to best accomplish the objectives of the original provision to the fullest extent allowed by law and the remaining provisions of these Program Terms shall remain in full force and effect.

ICON uses the information collected from you to provide quotations, make telephone contact and to email you marketing information which we believe may be of interest to you and your business. Cookies

ICON websites use cookies, which is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. We may use both “session” cookies and “persistent” cookies on the website. We will use the session cookies to: keep track of you whilst you navigate the website. We will use the persistent cookies to: enable our website to recognise you when you visit. Session cookies will be deleted from your computer when you close your browser. Disclosure

ICON may on occasions pass your Personal Information to third parties (as shown below) exclusively to process work on its behalf. ICON requires these parties to agree to process this information based on our instructions and requirements consistent with this Privacy Notice and GDPR.

We do not broker or pass on information gained from your engagement with us without your consent. However, we may disclose your Personal Information to meet legal obligations, regulations or valid governmental request. We may also enforce our Terms and Conditions, including investigating potential violations of our Terms and Conditions (Link to be provided) to detect, prevent or mitigate fraud or security or technical issues; or to protect against imminent harm to the rights, property or safety of ICON, our clients and/or the wider community.

We may share certain of your personal information with:

  • agents, contractors or third party service providers of The Icon who provide services to us for better serve your needs as a Guest;
  • Analytics and search engine providers that assist The Icon in the improvement and optimization of our website;
  • our professional advisors and auditors; and
  • local or foreign regulators, governments, courts, law enforcement and national security authorities.

Retention Policy

We will process your Personal Data during the duration of any contract and will continue to store your personal data until you exercise your right to be forgotten. In such case your Personal Data will be destructed within 30 calendar days from the date you have exercised your right to be forgotten, unless ICON has a valid and legitimate reason to the extent required or otherwise permitted by law, to continue to process and/or hold your personal data and you will be informed accordingly.

Data storage

Data is held in Cyprus, Italy, and Germany. ICON does not store personal data outside these areas.

Your rights as a data subject

We understand that you may like to know what personal information we hold about you. We are happy to assist you with your request. To protect your personal information, however, we require that you prove your identity to us at the time your request is made.

When you make a request in person, we will require you to produce some form of photo identification such as a passport or your ID card and you will be asked to sign a request form.

Where you make a request by other means, we request you contact us in writing via email, fax or letter including a copy of a government issued identification and signature. We require home and business addresses and phone numbers so we can check them with our files and verify your identity.

The above information is required to create an audit trail of how the request has been handled.

ICON reserves the right to decline access to your personal information under certain circumstances as permitted by law. If your personal information is not disclosed to you, you will be provided with the reasons for this non-disclosure.

You are entitled at any time to exercise the following rights:

  • Right of access – you have the right to request a copy of the information that we hold about you.
  • Right of rectification – you have a right to correct data that we hold about you that is inaccurate or incomplete.
  • Right to be forgotten – in certain circumstances you can ask for the data we hold about you to be erased from our records.

After you have chosen to withdraw your consent ICON may be able to continue to process your personal information to the extent required or otherwise permitted by law.

Interpretation

We, us, our or ICON - refers to Y.A.M. Imperio Enterprises LTD, a company incorporated and validly existing in the Republic of Cyprus, with Registration no. HE141929 and any of its Subsidiaries and/or Affiliated Companies.
